WHILE HCC USES GOOD FAITH EFFORTS TO KEEP INFORMATION CURRENT AND ACCURATE, ERRORS MAY OCCUR. In no event shall HCC (or any entity controlling, controlled by or under common control with HCC) or HCC’s parent, subsidiaries, affiliates, officers, directors employees or agents, assignees or any of the foregoing’s predecessors or successors in interest be liable to you or to any third party, for any direct, indirect, special, consequential or incidental damages, however caused and under theory of liability arising hereunder, access to the Portal or your use of the information in the Portal whether or not advised of the possibility of such damages, and notwithstanding any failure of essential purpose of any limited remedy.
Ownership
You agree that HCC owns all right, title and interest in and to the Portal and the information therein.
Indemnity
As a condition of your use of the Portal, you agree to indemnify and hold HCC (or any entity controlling, controlled by or under common control with HCC) or HCC’s parent, subsidiaries, affiliates, officers, directors employees or agents, assignees or any of the foregoing’s predecessors or successors in interest or providers harmless from and against any and all claims, losses, liability, costs and expenses (including but not limited to attorneys' fees) arising from your use of the Portal, or from your violation of these Terms of Use.
Termination of Access
HCC may terminate your access to the Portal for any reason, without prior written notice.
